Terms and conditions

1. Who we are

This online store is run by tex-shop, a business registered in Poland, Storczykowa 21, 07-203 Popowo-Parcele, Poland. Email: dap.gml@gmail.com. In these terms "we", "us" and "our" mean tex-shop, and "you" means the customer.

These terms apply to every order placed on this website, for customers in the United Kingdom and in Poland. Please read them before you order. You can save or print this page.

2. What we sell and how we fulfil orders

We sell consumer products: computer accessories, keyboards, monitors, game consoles, fitness equipment and sports supports. We do not keep our own warehouse. Your order is packed and sent by our suppliers from their warehouses, which may be outside the UK and outside the EU. If you order several items, they may arrive in separate parcels.

Product photos and descriptions show the product as accurately as we can. Colours on screen may look slightly different in real life. Where the supplier has not given us a piece of information, we say so on the product page.

3. Who can order

You must be at least 18 years old to place an order. Our store is intended for consumers buying for personal use. If you buy as a business, sections 8 and 9 on consumer rights do not apply to you, but section 10 still does.

4. Prices and payment

  • Prices are shown in pounds sterling (GBP) for the United Kingdom and in Polish zloty (PLN) for Poland.
  • Prices include VAT where it applies. Delivery is included in the price unless checkout shows otherwise.
  • The price you pay is the price shown at checkout when you place your order.
  • You pay at checkout using the methods shown there (for example card, PayPal, Shop Pay, Google Pay). We do not see or store your full card details.
  • If a price is obviously wrong because of an error, we will tell you before dispatch and you can choose to order at the correct price or cancel for a full refund.

5. How the contract is made

When you place an order, you make an offer to buy. We email you an order confirmation. The contract between us is made when we send that confirmation. If we cannot accept your order (for example because the product is no longer available), we will tell you and refund any payment in full.

6. Delivery

  • We deliver to addresses in the United Kingdom and in Poland.
  • Estimated delivery times are shown on the product page and in our Shipping policy. They are estimates from our suppliers, not guaranteed dates.
  • We email you a tracking number once your parcel has been dispatched.
  • The products are your responsibility from the moment they are delivered to you or to a person you have named.
  • If your order has not been delivered within 30 days of the order date, you can cancel it and we will refund you in full.
  • Please check your delivery address carefully. If a parcel is returned to us because the address was wrong or incomplete, we will contact you to arrange delivery again or a refund.

Import charges

For UK orders worth £135 or less, UK VAT is included in the price at checkout and you should not be asked to pay import VAT on delivery. For UK orders above £135, import VAT and customs duty may be payable on delivery. If this applies to your order, we will tell you before dispatch and you can cancel for a full refund.

7. Returns for any reason (30 days)

You can return any product within 30 days of delivery for any reason. This is longer than the legal minimum of 14 days.

  • To start a return, email us with your order number within 30 days of delivery. We will send you the return address and instructions. Please do not send parcels without contacting us first, because returns do not go to the address in section 1.
  • Send the product back within 14 days of telling us, complete with all accessories. Use the original packaging if you still have it.
  • You pay the cost of sending the product back, unless it is faulty or we sent you the wrong item.
  • You may handle the product as you would in a shop to check it. If its value has gone down because it was handled more than that, we may reduce your refund accordingly.
  • We refund you within 14 days of receiving the product back, or of receiving proof that you sent it, whichever is earlier. We refund the price you paid, including any standard delivery charge, to your original payment method.

8. Your legal right to cancel

Customers in the United Kingdom

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you can cancel your contract within 14 days of the day you receive the products, without giving a reason. Our 30 day return period in section 7 includes this right and gives you more time.

Customers in Poland

Under the Polish Consumer Rights Act (ustawa o prawach konsumenta) you can withdraw from the contract within 14 days of receiving the products, without giving a reason. Our 30 day return period in section 7 includes this right and gives you more time. You can use the model form below, but you do not have to.

9. Faulty or wrong products

Every product must be as described, fit for purpose and of satisfactory quality. If a product arrives damaged, faulty or is not what you ordered, email us with your order number and a photo of the problem. We pay the return postage in these cases, and sometimes we will not need the product back.

Customers in the United Kingdom

Your rights under the Consumer Rights Act 2015 include:

  • within 30 days of delivery: a full refund for a faulty product;
  • within 6 months of delivery: a repair or replacement, and if that is not possible or does not fix the problem, a refund; after 6 months you may need to show that the fault was there at delivery;
  • up to 6 years after delivery (5 years in Scotland): you can still claim for a fault, with a refund reduced to reflect your use of the product if a repair or replacement is not possible.

Customers in Poland

Under the Polish Consumer Rights Act we are responsible for any lack of conformity with the contract that exists at delivery and becomes apparent within 2 years. You can ask for a repair or replacement, and in cases set out in the Act for a price reduction or a refund. We reply to a complaint within 14 days; if we do not, the complaint is treated as accepted.

Nothing in these terms limits your statutory rights.

10. Our responsibility

  • We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.
  • We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be excluded by law, including your rights for faulty products.
  • We are not responsible for business losses. Our products are for personal use only.
  • Please follow the instructions and safety information supplied with each product. Sports supports are not medical devices and do not replace advice from a doctor or physiotherapist. Fitness equipment should be used within your own ability, and children should use it only under adult supervision.

11. Using this website

This website lets you browse products, place orders, create an account and contact us. To use it you need an internet connection, an up to date web browser with JavaScript and cookies enabled, and an email address.

You must not use the website in a way that is unlawful or that interferes with its operation, and you must not submit unlawful content, for example in reviews or messages. If you have a complaint about the website itself, email us and we will reply within 14 days.

The texts, photos and design of this website belong to us or to our licensors. Please do not copy them without permission.

12. Your personal data

We use your personal data as described in our Privacy policy.

13. Disputes and applicable law

If you have a problem, please contact us first at dap.gml@gmail.com. Most issues can be solved quickly by email.

  • Customers in the United Kingdom: these terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales, or in Scotland or Northern Ireland if you live there.
  • Customers in Poland: these terms are governed by Polish law. You can bring legal proceedings in the Polish courts. You can also get free help from your local consumer ombudsman (miejski lub powiatowy rzecznik konsumentów) or the Trade Inspection (Inspekcja Handlowa).

Choosing a governing law never removes the mandatory consumer protections of the country where you live.

We may update these terms from time to time. The version that applies to your order is the one published on this website when you placed the order.
